Law suit against homosexual in Nebraska by a woman maintaining a representative action for herself , Jesus and God

some weeks ago the Supreme Court began to hear arguments in a historic gay marriage case that could potentially lead to same-sex marriage being approved nationally. And while many rejoiced at the possibility of loving couples across the country finally being able to marry in all 50 states, othe disapproved such disposition. However, one Nebraska woman took her reservations and opposition to same-sex couples to new heights by deciding to sue all homosexuals. According to the Omaha.com, Sylvia Ann Driskell, 66, a self-identified ambassador for God and his son, Jesus Christ, is asking the U.S. District Court of Omaha to decide if homosexuality is a sin or not. In an apparent seven-page letter sent to the court, Driskell cited Bible passages describing homosexuality as an abomination arguing, That homosexuality is a sin and that they the homosexuals know it is a sin to live a life of homosexuality. Why else would they have been hiding in the closet(?) Driskell in a representative capacity sued "ALL HOMOSEXUAL" for himself and on behalf of God and Jesus Christ. witout the employment of any counsel the action is bound to hit the rocks. Even if a counsel is employed, it will be farciacl to think such moral stand can actually overid the positive law in force endorsing and ratifying such union. This is not to say the plaintiff does not have a point but as it stands, conflict between moral standard and law will be resolved in favour of the law. lookihg beyound the plaintiff trying to gain cheap popularity and embarking on a mission to waste the precious time of the court, this suit by Sylvia and Driskel no matter how ridiculous it is raises cultural and legal question. Though culture does not enjoy any consensus of defination by scholars as to the element that should be inherent or contained in the defination culture. To some scholars, culture includes the totality of how a community sees and interpret things which makes culture to include what the law in such community is and what it is not; the punishment to be meted out in case their is a breach of law in such community, while other scholars does not include law in their defination.They argued that law should necessarily look beyound the culture as to be accommodating and all embracing by different people residing in such community or state or country.Though United State will want to make every body believe that the legalisation of the same sex marriage reflect the public opinion when it was passed.But the aftermath of the event of the passage has painted a different picture entirely.This simply means, beyound the bible and the Quran reservations on this, the dissenting opinion on the lagalisation of same sex were not put into consideration. This singular fact has resulted in despaire of those morally averse to the legalisation of same sex from airing their view without fear of retribution it has even resulted in a situation where those who stood by their moral convinction being sentenced to imprisoment. Denying some set of people the full enjoyment of their right as a result of their moral stand in other to protect the right of another is against any constitution in the world whose government is founded on democratic principle. This action is against the first amendment to the bill of right (arguably the most important part of the U.S. Constitution) of the United State of America which guarantees among other rights freedom of religion and conscience. "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances." Any law of a country that guaranty the freedom of religion should have comtemplated the laws/commandments, ways of life or moral standard contained therein and should have been prepared to find a way to resolve any conflict that arises either between the religion and the state or between such religion and individual without denying the right of one against another.it is fair to say the legalisation of same sex marriage by the United State has denied some set of citizen the enjoyment of the fullness of their right as contained in their law.
